Semi-truck repair services facility in a General Business Zoning District where that use is neither a permitted nor a special exception use.
Conditions: 1) Facility shall not be open to the general public. 2) No expansion to the existing structure. 3) All outdoor storage shall be in the rear yard, behind the building.

Year-End Report 2009 (Code Enforcement)

The Steuben County Plan Commission is responsible for enforcing several County Ordinances: the Zoning Ordinance, the Subdivision Control Ordinance, Ordinance 658 (Public Environmental Nuisances), and Ordinance 771 (Abatement of Abandoned Motor Vehicles).

In 2009, the Plan Commission processed 102 environmental nuisance complaints, 34 abandoned vehicle complaints, and 175 other ordinance violations. A total of 470 cases have been closed this past year.

The following graph shows new ordinance violation cases by month. The first bar is public environmental nuisances, the second is abandoned vehicles, and the third is other ordinance violations.

In addition to the above actions, the Plan Commission conducted a “clean-up day” in cooperation with the Walden Woods Community Association and Steuben County Community Service Workers. Two 40-yard dumpsters were filled over the weekend.

Towards the end of 2009, the Plan Commission began an effort to modernize and streamline code enforcement procedures. This overhaul process is only beginning; it may be several months until the full impact and benefits of these reforms will be realized. Our goal is to have all code enforcement cases resolved or sent to the court within 90 days of receiving a complaint or identifying a violation.

Updated Ordinances Now Available

The updated Steuben County Zoning Ordinance and Steuben County Subdivision Control Ordinance are now available from the Plan Commission website.

To download the documents to your computer, click on the document. A window will pop up asking if you want to save the file or open it.

Both files are in pdf format. The Zoning Ordinance is 2.8 MB, and the Subdivision Control Ordinance is 611 KB. If you don't have a fast connection, it will take a while for the documents to download.

If you have a previous version of either of these documents, the Plan Commission has prepared "update packets" with the new pages and instructions. Please contact this office to receive one of these packets.

New GIS Feature- February 11, 2010

The Steuben County Plan Commission is pleased to announce a new feature has been added to the County's online GIS. It is now possible to view the Lakes Advisory Board Jurisdiction on the map.

Here is how to view this information:


Point your web browser to the
Steuben County GIS.

When you get to the map, open the "Planning Menu" on the left-hand side by clicking in the small box with the "+" on the left hand side of "Planning". (Illustrated by the red arrow below.)


This will open up several new options for you to select. Scroll down the menu on the left until you see "Lakes Advisory Board Area." Select this by clicking the open box on the left of "Lakes Advisory Board Area." (Illustrated by the red arrow below.)


The Lakes Advisory Board Area is now shown with a blue color overlaying the map. This area is especially important for the water quality of the many lakes in Steuben County.


The Lakes Advisory Board was created by the Steuben County Plan Commission to advise it on proposed projects within this area.

The Plan Commission would like to thank GIS Coordinator Chad Hoover for his efforts developing this feature.

County Park Charrette- February 9-10, 2010

The Steuben County Commissioners, in consultation with The Troyer Group, have organized a public meeting to discuss the master plan for improvements to Steuben County Park. During the meeting, those in attendance will have a chance to provide input on what improvements they would like made to the park.

At 6:00 p.m., there will be a brief presentation to introduce the master planning process. After that, there will be small groups organized to give individuals an opportunity to work closely with the park representatives and consultants to brainstorm ideas that will have an impact on future development for the park.

Those attending should consider the following questions prior to the charrette to make the event as productive as possible:
What would the ideal park/fairground include?
What is missing from the park/fairground?
What are some characteristics of your favorite parks/fairgrounds?
What can the park/fairground include to generate revenue?
What can be done to improve circulation at the park/fairground?

Zoning & Subdivision Control Ordinances Update

The Steuben County Board of Commissioners have approved the following amendment to the Steuben County Zoning Ordinance:

(A-10-01) An amendment to the Steuben County Zoning Ordinance concerning the definition of structures, the definition of basements on a sloping lot, accessory uses, the number of accessory buildings, mini/self-storage warehouses, retaining walls, low-impact home occupations, & handicapped ramps.

First Reading- January 19, 2010.
Second Reading- February 1, 2010.
Third Reading- February 1, 2010.

Plan Commission Results- February 3, 2010

1. (VPW-10-01) Laura & Richard Clifton petition for the vacation of a public way. Proposed vacation is a four (4) foot wide walkway located between lots five & six of Lone Tree Point.

Petition forwarded to the County Commissioners with No Recommendation (5-2-1).

2. Appointments to the Lakes Advisory Board.

Vicki Banks was appointed to serve on the LAB with term ending December 31, 2011, & Tom Hazelett was appointed to serve on the LAB with a term ending December 31, 2012. (8-0).

We want to thank all of the individuals who expressed interest in volunteering their time to serve on the Lakes Advisory Board.

3. New fee schedule for administrative land divisions & wind conversion systems.

Fee schedule will be forwarded to the County Commissioners with a Favorable Recommendation (7-0-1).

4. Review of proposed changes to the Rules of Procedure for the Steuben County Plan Commission concerning a code of ethics and behavior.

The Plan Commission requested staff to make some changes to the proposed rules change. Changes will presented to the Plan Commission in March for approval.

Last month, we discussed some proposed changes to the Steuben County Zoning & Subdivision Control Ordinances. This time, we will give an update and talk about the ordinance amendment process in general.

Ordinance Amendment Update. The Steuben County Plan Commission (PC) held a public hearing to consider the proposed changes on January 6. The PC voted to forward the proposed changes to the County Board of Commissioners (Commissioners) after a public hearing. The Commissioners conducted their first reading of the proposed changes at their January 19th meeting. They are scheduled to conduct the second and third readings of the proposed changes at their next meeting on Monday, February 1.

Following that reading, the proposed changes will be officially on the books. The Plan Commission Office has prepared new versions of the Zoning Ordinance and Subdivision Control Ordinance. The updated versions will be available on the Steuben County Website, www.co.steuben.in.us, several days afterwards. They will be available electronically immediately; contact us if you would like us to send you a copy. We will also have available a packet to allow people to update previous versions of the Ordinances without having to print all of the pages.

Ordinance Amendment Process. How Zoning Ordinances are amended may be almost as mysterious as how they are adopted in the first place. The process is generally similar within the State of Indiana but varies from state to state. Indiana outlines the steps in state law, and the Steuben County Zoning Ordinance further defines the process locally.

There are two basic paths to amending an ordinance. The PC may start the process, or the PC may be directed to amend the ordinance by the Commissioners. For a member of the public, the path is a little bit longer; he must start by petitioning the Commissioners to direct the PC to amend the Ordinance.

All proposed changes to an ordinance must have a public hearing before the PC, with proper legal notification in the newspaper. Members of the public are free to comment on the proposed changes during the hearing. The PC forwards the proposed amendment to the Commissioners with a favorable, unfavorable, or no recommendation. The Commissioners may accept or reject the amendment. If accepted, it becomes official.

Annual Ordinance Reviews. The Steuben County PC has implemented a policy of annual reviews to the Zoning Ordinances. This is done to address any issues that have surfaced in the previous year and to keep the ordinances current. It is much easier to make minor changes than to wait and make large changes.

We have conducted two annual reviews (even though the “new” ordinances only became effective sixteen months ago) and have passed two amendments to the ordinance with another coming soon through this process.

Throughout the year, Staff reviews the ordinances and notes frequently requested variances. Even though the previous round of changes is not official yet, we are already starting the process for the end of this year.

Citizen Initiated Reviews. While Indiana Law and the Steuben County Ordinance do not specifically address how members of the public may request ordinance amendments, there is a method available. The process must be officially initiated by either the PC or the Commissioners.

A member of the public may request to appear before the Commissioners and make his case for a proposed amendment. The Commissioners may then decide to initiate the process and direct the PC to prepare an amendment.
