Results of the September 14, 2009, BZA Hearing

Following are the results of the Steuben County Board of Zoning Appeals for September 14, 2009.

Elections.
Doug Smith elected Chairman (5-0)
Bill Schmidt elected Vice-Chairman (4-0-1)

Note: Special election due to Chairman DeMarco stepping down from the chair at present. Elected positions will run through the present term, 31 December 2009.

V-09-37A Leininger (5-0)

Roadside setback of twelve (12) feet rather than the twenty-five (25) feet required.
Condition: Setback measured from the current road right-of-way.
V-09-37B Leininger (5-0)
Side-yard setback of zero (0) feet rather than the five (5) feet required for at grade steps.
Note: Steps will be shared with the neighbor to the east and will be constructed half on each property.
V-09-37C Leininger (5-0)
Height of three (3) stories and thirty-five (35) feet rather than the two (2) stories and twenty-seven (27) feet allowed.

V-09-38A Baldwin (3-2)
Mini/self-storage in a Lake Residential where proposed use is neither a permitted or special exception use.
Conditions: Structures may be no larger than presented, covenants & restrictions shall be approved by Plan Staff & Attorney and address height, Plan Commission enforcement, & managing access/security, and drainage shall be approved by the drainage board.
V-09-38B Baldwin (1-4) DENIED
Thirty-seven (37) buildings rather than the thirty-one (31) permitted.

V-09-39A McCabe (5-0)
Height of three (3) stories and thirty-seven and five-tenths (37.5) feet rather than the two (2) stories and twenty-seven (27) feet allowed.
V-09-39B McCabe (5-0)
Roadside setback of twenty-two (22) feet rather than the twenty-five (25) feet allowed.
V-09-39C McCabe (5-0)
Side-yard setback of zero (0) feet rather than the five (5) feet required for at-grade steps.
