Site Survey Reminder- June 24/25, 2010

Steuben County Plan Commission members will conduct a site survey on Thursday, June 24, 2010. The site survey begins at the Community Center, 317 S. Wayne, Angola, IN, parking lot at 8:00 am. Various locations will be visited.

Steuben County Board of Zoning Appeals members will conduct a site survey on Friday, June 25, 2010. The site survey begins at the Community Center, 317 S. Wayne, Angola, IN, parking lot at 7:00 am. Various locations will be visited.

Members of the public may be present. However, no evidence or testimony may be taken on the site survey.

Staff Training

Two members of the Plan Commission Staff, Assistant Plan Director Vina Conti and Code Enforcement Technical Scott Essenberg, have completed the Michigan Citizen Planner training program.

(There is no equivalent program in Indiana at this time.)

The Michigan Citizen Planner program was developed by the Michigan State University Extension and administered by the MSU Land Policy Institute.

The program is available to all of those interested in planning and land use. It can be taken in a classroom setting or as an online course.

County Commissioners Results- June 21, 2010

The following items were heard by the Steuben County Board of Commissioners at their meeting on Monday, June 21, 2010.

(Z-10-05) Steuben County Plan Commission - APPROVED (First Reading)
Zone change from Local Business to Environmental Control.
First Reading- June 21, 2010

The County Commissioners gave approval for the Plan Commission to spend $1,000 - $1,500 from its code enforcement fund to clean 10 yards.

The County Commissioners approved a reduced fee of $225 for a vacation of several lots in Snow Lake Park Subdivision that are overlapped by Sleepy Hollow Subdivision.

The County Commissioners approved, in concept, the Plan Commission developing an unpaid summer internship. The Plan Commission will develop an internship description to present to at their next meeting.

Code Enforcement Tear-Downs Update

The tear-downs scheduled for today, Monday, June 21, 2010, have been delayed for several days.

We will broadcast the tear-downs when they take place.

The Steuben County Building Department will be conducting tear-downs of several unsafe properties. The tear-downs are scheduled to take place on Monday, June 21, 2010.

If technical issues allow, the tear-downs will be broadcast on the Steuben County Plan Commission special events webstream. The video will also be available for later viewing.

Land-Use Video Seminar- June 17, 2010

The Steuben County Plan Commission and Steuben County Purdue Extension will host a Purdue Extension video seminar on Thursday, June 17, 2010, from 7:00 pm to 9:00 pm. The topic for this seminar is “Healthier Communities through Planning.”

The interactive program will focus on how communities can support healthier lifestyles for their residents by implementing various design criteria, ordinances, and policies. Background information and stories from communities already involved is this area will be shared. The economic impact of these “healthy” land-use policies will also be explored.

Kim Irwin of Health by Design will be the main presenter.

The video seminar is free and open to all local officials and the general public. Refreshments will be provided.

The video seminar will take place in the Steuben County Purdue Extension conference room in the basement of the Steuben County Community Center, 317 S. Wayne, Angola, IN.

BANI Newsletter- June 2010

There was a lot of buzz and phone calls in the end of April this year when the Steuben County Board of Commissioners approved A-10-03, an amendment to the Steuben County Zoning Ordinance.

The headline in the paper was “County to Prohibit Post-Construction Variances.” It can be easy to misinterpret this headline as meaning the County intends to prohibit post-construction buildings (pole barns). That is not the case.

Let’s clear up any potential confusion.

The amendment added two more decision criteria that Board of Zoning Appeals members consider when determining whether or not to approve a developmental standard variance. These are typically variances for reduced setbacks, for increased height, or reduced building/impermeable coverage.

Here are the two additional criteria:

(6) The need for the variance is not the result of actions of the property owner, previous owners, or their agents.
(7) The variance requested is the minimum necessary to mitigate an unnecessary hardship.


The first addition is often referred to as a “self-created hardship” clause. For example, if you build a deck where it shouldn’t be, you are the one responsible for creating the hardship. When this amendment becomes effective, the Steuben County BZA will not be able to approve any post-construction variance. The only remedy will be to remove the structure and then to apply for the necessary variance(s).

The second addition is often referred to as a “minimum necessary relief” clause. Variances exist to allow use of property when the strict application of the zoning ordinance is equivalent to the government taking the property through eminent domain. A variance relieves this situation by allowing for use of the property. This clause means that the variance asked for is the smallest variance necessary for the property to be considered useable.

The Plan Commission Office requested that this amendment have a delayed effective date. The County Commissioners agreed; the above amendment will become effective on Tuesday, August 17, 2010.
